I'm pretty sure you have to get it from the dealer. They will order it from Germany and you have to provide your driver's license and registration to prove you are the owner of the car. Even you were able to find one from a third party, you'd need to pay the dealer to have it programmed.

I lost a key to our '09 and I had to go to the dealer. You can buy a key fob on ebay but it won't work till the dealer codes it. They get your money either way.

on a gen2 like yours it has to be ordered by the dealer from MINI USA in New Jersey. It will work as soon as it arrives to start and unlock your car. If you have comfort access is when the local dealer has to put it on the computer to sync your car and fob and it will cost you an hour in labor on top of the fob price. We went through this on Brandy's countryman as it only had one key when we bought it, no cost just the hassle. I thing the coded fob is between 200 and 250 and if comfort access add an additional 125 bucks.
